These Terms of Service ("Terms") govern your use of applications and services provided by PM4Subs LLC ("we", "us", "our"), including PM4Subs, HeaderTracker, Forward Command, time4subs, Rentals4Subs, Tools4Subs, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
The Services are intended for use by construction subcontractors, their employees, and authorized personnel. By using the Services, you represent that you are at least 18 years old and have the authority to agree to these Terms on behalf of yourself or your organization.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.

You retain ownership of all data you submit to the Services, including project information, schedules, time records, photos, and other business data. We do not claim ownership of your content. You grant us a limited license to use your data solely to provide and improve the Services.

Certain Services, including HeaderTracker and Forward Command, may send SMS text messages for scheduling updates, time tracking alerts, and job site communications. By opting in to text messaging, you agree to receive recurring messages. Consent to receive text messages is not required as a condition of using the Services.
Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. For more details, see our Privacy Policy.
Forward Command may request access to your device's location services, camera, and microphone to provide core functionality including job site verification, clock-in photo capture, and voice-based time entry. These permissions are only used when actively requested by you and are not used for background tracking or surveillance. Voice recordings are processed temporarily and are not stored.
We strive to maintain reliable access to the Services but do not guarantee uninterrupted or error-free availability. The Services are provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Services at any time with reasonable notice when possible.
To the maximum extent permitted by law, PM4Subs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim related to the Services shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless PM4Subs LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.
Either party may terminate the use of Services at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will make your data available for export for a reasonable period following termination upon request.
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Multnomah County, Oregon.
